Tennessee now requires large data centers to pay for the grid infrastructure they need, aiming to protect households from rising electricity costs.
Tennessee Draws a Line: Data Centers Must Pay for Their Power
Tennessee just made its position clear.
If you build a data center, you pay for the infrastructure needed to power it.
A new law, HB 1847, signed by Bill Lee, requires large data centers to cover the full cost of grid upgrades tied to their demand.
What the Law Covers
The rule applies to facilities that reach at least 50 MW of peak demand within their first three years.
That includes more than just basic connections.
Infrastructure costs can include:
- ●New substations
- ●Transformers
- ●Transmission and distribution upgrades
- ●Any added capacity built mainly for that facility
Utilities are not allowed to pass these costs on to other customers.
Why This Matters
That share is expected to grow as AI and cloud demand expand.
Without rules like this, the cost of building new infrastructure would likely be spread across all ratepayers.
This law changes that.
A Model Already in Use
This approach is not entirely new.
When xAI built its Colossus supercomputer in Memphis, it secured its own dedicated power supply, including acquiring generation to meet its demand.
HB 1847 turns that kind of approach into policy.
If a project creates large new demand, it is responsible for supporting it.
The One Exception
There is some flexibility.
If a grid upgrade clearly benefits the broader system, not just the data center, part of the cost can still be shared.
That’s where interpretation becomes important.
What counts as a “shared benefit” is not always clear, and that is where future debate will likely focus.
What This Signals
Tennessee is still open to data center growth.
But it is setting boundaries around cost responsibility.
As electricity demand rises, more states may move in this direction.
The core question is simple.
If large users drive new demand, should they also carry the cost of building the infrastructure to support it?
